If you do not agree with any part of these Terms, please do not access or use this Platform.
Our Platform connects job seekers with employers, provides recruitment tools, and facilitates professional networking within Tanzania. These Terms govern your relationship with Vicent JOBS.
2. Eligibility
By using this Platform, you represent and warrant that:
- You are at least 18 years old or the age of majority in Tanzania.
- You have the legal capacity to enter into a binding agreement.
- If you are registering on behalf of an employer, you have the authority to bind that organization to these Terms.
- You will comply with all applicable laws and regulations while using the Platform.
If you are under the age of 18, you may only use the Platform with the supervision and consent of a parent or legal guardian.
3. Account Registration and Security
3.1 Registration
To access certain features on Vicent JOBS, you must register for an account. When registering, you agree to:
- Provide accurate, current, and complete information.
- Maintain the confidentiality of your login credentials (username and password).
- Notify us immediately of any unauthorized use of your account or breach of security.
3.2 Account Types
There are two main types of accounts on Vicent JOBS:
- Job Seeker Account: For individuals seeking employment opportunities.
- Employer Account: For companies, organizations, or recruiters seeking to hire talent.
You may maintain multiple accounts if allowed by the nature of your use (e.g., a recruiter managing multiple branches), provided each account reflects a distinct role and complies with our policies.
3.3 Account Verification
Vicent JOBS reserves the right to verify your identity, company registration documents, or professional credentials at any time. Failure to provide requested verification may result in suspension or termination of your account.
4. User Obligations
4.1 Job Seekers
By using Vicent JOBS as a job seeker, you agree to:
- Submit truthful and accurate information in your profile, resume, and cover letter.
- Not submit multiple profiles for the same individual unless explicitly permitted.
- Respect the hiring process of employers and refrain from spamming applications.
- Not misrepresent qualifications, experience, or educational background.
- Keep contact information up to date so employers can reach you if necessary.
4.2 Employers
By using Vicent JOBS as an employer, you agree to:
- Post only genuine, legitimate job vacancies available with your organization.
- Provide accurate descriptions of the role, responsibilities, requirements, and compensation.
- Comply with all labour laws and employment standards of Tanzania when advertising positions.
- Handle applicant data responsibly and in accordance with our Privacy Policy.
- Settle all fees related to premium services, subscription plans, or job posting fees promptly via accepted payment methods.
5. Prohibited Conduct
Users are strictly prohibited from engaging in the following activities on the Platform:
- Fraud and Misrepresentation: Posting fake jobs, impersonating other users, or providing false identification.
- Illegal Activities: Soliciting illegal goods or services, money laundering, or anything otherwise prohibited by Tanzanian law.
- Harassment: Sending offensive, threatening, abusive, or discriminatory messages to other users.
- Spam: Bulk messaging unsolicited advertisements or commercial solicitations without consent.
- System Interference: Attempting to gain unauthorised access to servers, databases, or other users’ accounts (hacking, phishing, etc.).
- Scams: Requesting money, bank details, or sensitive personal information from job seekers before an official interview or contract signing.
- Infringement: Violating any third-party intellectual property rights (copyrights, trademarks, patents).
We reserve the right to remove any content or terminate accounts involved in such activities without prior notice.
6. Intellectual Property
6.1 Vicent JOBS Rights
The Platform, including its design, layout, software, logos, content, and code, is owned by Vicent JOBS and protected by international copyright and trademark laws. You may not copy, modify, distribute, sell, or lease any part of our Platform without explicit written permission.
6.2 Your Content
You retain ownership of the content you upload to the Platform (e.g., resumes, cover letters, company descriptions). However, by uploading such content, you grant Vicent JOBS a non-exclusive, worldwide, royalty-free licence to use, store, display, and distribute this content solely for the purpose of operating and improving the Platform.
6.3 Trademarks
All trademarks, service marks, and trade names appearing on the Platform belong to Vicent JOBS or their respective owners. Nothing in these Terms grants you the right to use any trademarks belonging to Vicent JOBS without permission.
7. Disclaimers and Warranty
7.1 “As Is” Basis
The Platform is provided on an “as is” and “as available” basis. Vicent JOBS makes no warranties, express or implied, regarding:
- The accuracy, completeness, or reliability of job listings or employer information.
- The availability of jobs matching your criteria.
- The success of any job applications submitted through the Platform.
- That the Platform will be uninterrupted, secure, or error-free.
7.2 No Employment Relationship
Vicent JOBS is a recruitment intermediary, not an employer. By using this Platform:
- We do not create an employer-employee relationship between you and any advertiser.
- We do not screen, endorse, guarantee, or vouch for the competence, qualifications, or integrity of job seekers or employers.
- Any employment agreement is solely between the job seeker and the hiring company.
- We are not liable for disputes arising between job seekers and employers regarding contracts, salary, or working conditions.
8. Limitation of Liability
To the maximum extent permitted by law, Vicent JOBS shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:
- Your use of or inability to use the Platform.
- Any conduct or content of any third party on the Platform.
- Unauthorised access to or alteration of your transmissions or data.
- Any loss of revenue, profit, or business opportunity.
Your total liability for damages arising from your use of the Platform is limited to the amount you paid to Vicent JOBS (if any) in the twelve months preceding the claim, or TSh 1,000 (one thousand Tanzanian Shillings), whichever is greater.
This limitation applies regardless of whether the cause of action is based in contract, tort (including negligence), or strict liability.
9. Termination and Suspension
Vicent JOBS reserves the right to suspend or terminate your account and access to the Platform at our sole discretion, for any reason (including no reason), with or without prior notice. This includes, but is not limited to:
- Violation of these Terms.
- Engaging in fraudulent, illegal, or harmful activity.
- Prolonged inactivity (account unused for more than 12 months).
- Failure to verify account information upon request.
Upon termination, your right to use the Platform ceases immediately. All provisions of these Terms that require ongoing performance (such as Intellectual Property rights, Disclaimers, Indemnity, and Governing Law) shall survive termination.
10. Indemnification
You agree to indemnify, defend, and hold harmless Vicent JOBS, its affiliates, licensors, employees, agents, and partners from any claims, liabilities, damages, judgments, losses, costs, or expenses (including legal fees) arising out of or relating to:
- Your violation of these Terms.
- Your use of the Platform.
- Your content or actions posted or transmitted on the Platform.
- Your violation of any third-party rights (including intellectual property rights).
11. Payment Terms (Employers Only)
For employers utilising premium services or paid job postings:
- Fees are denominated in Tanzanian Shillings (TZS) unless otherwise specified.
- Payment must be received before a job is activated or a service begins.
- Refunds are generally not provided once a job has been posted or viewed by applicants, except where required by Tanzanian Consumer Protection Regulations.
- Subscriptions automatically renew unless cancelled prior to the renewal date.
12. Third-Party Links
The Platform may contain links to third-party websites, social media platforms, or services that are not operated or controlled by Vicent JOBS. We are not responsible for the content, privacy policies, or practices of any third-party sites. You acknowledge that we have no control over and assume no responsibility for such external sites.
13. Governing Law and Jurisdiction
These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of the United Republic of Tanzania, including the Contract Act, Electronic and Postal Communications Act (EPOCA), and Cybercrimes Act.
Any legal proceedings or disputes arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Dar es Salaam, Tanzania.
14. Modifications to Terms
Vicent JOBS reserves the right to modify or replace these Terms at any time. We will provide reasonable notice of material changes by:
- Updating the “Last Updated” date at the top of this page.
- Posting a prominent notice on the Platform.
- Sending an email notification to registered users.
Your continued use of the Platform after any changes constitutes your acceptance of the modified Terms.
